Processing of Personal Data

§ 1 Subject of the Agreement

(1) This contract component is the use of the software offered at chorilo.com as Software as a Service (hereinafter referred to as "Software").

(2) This Data Processing Agreement ("DPA") is concluded between Chorilo - Melanie Schneider – Tränkstraße 3, 65558 Holzheim (hereinafter referred to as "Processor") and the customer of the offered software (hereinafter referred to as "Controller"). Together, the Processor and the Controller are hereinafter referred to as the "Parties".

(3) This DPA supplements the service contract concluded between the parties based on the currently valid terms and conditions of the Processor (hereinafter referred to as "Main Contract"). The subject matter and duration as well as the type and purpose of the processing result from the Main Contract.

§ 2 Rights and Obligations of the Client

(1) The Controller provides the data to the Processor via the software used by the latter by entering it via forms or uploads, or by telephone or e-mail, or enables the processing of the data by the Processor. All data that the Controller enters via the fields in the forms is transferred to the Processor's software via the Secure Sockets Layer (SSL) encryption protocol via an encrypted connection after pressing the "Send" or "Save" button.

(2) The Controller remains the "Controller" within the meaning of Art. 4 No. 7 GDPR and is responsible for compliance with the legal provisions of data protection laws, in particular for the lawfulness of the data transfer to the Processor and for the lawfulness of data processing. The Controller is also responsible for assessing the permissibility of data processing and for safeguarding the rights of data subjects.

(3) The instruction is the order directed at a specific data protection handling (for example, anonymization, blocking, deletion, release) of the Processor with personal data. The Controller's instructions must be given in writing or by e-mail.

(4) The handling of the data takes place exclusively within the framework of the agreements made and according to the instructions of the Controller. The Controller has the right to issue instructions on the type, scope and procedure of data processing. The instructions are initially determined by the Main Contract and the DPA and can then be changed, supplemented or replaced by the Controller in writing or in text form (e-mail) to the location designated by the Processor by individual instructions. Changes to the processing object and procedural changes must be agreed upon jointly and documented. Instructions not provided for in the contract will be treated as a request for a change in service.

(5) Instructions are to be directed by the Controller to the Processor, Chorilo - Melanie Schneider, Tränkstraße 3, 65558 Holzheim or by e-mail (in text form) to [email protected] or a new e-mail address communicated in writing. Verbally given instructions must be confirmed in writing or in text form without delay.
